Labour Investigations Unit
The Labour Investigations Unit at the Department of Labour and Pensions (The DLP) is overseen by the Deputy Director for Labour and is comprised of (4) Senior Labour and Pensions Inspectors, (1) Senior Labour and Pensions Inspector (Gratuities), (2) Labour and Pensions Inspector, and (1) Assistant Labour and Pensions Officer.
The main objective of the Labour Investigations Unit is the enforcement of the Labour Act (2021 Revision). The unit has the responsibility of conciliating individual disputes of rights between employers and employees regarding matters such as non-payment of vacation pay, sick leave, wages, minimum wage compliance etc.

Registration of Workplaces
Every person who lawfully operates a business shall within one month of commencement register with the Director of Labour & Pensions by completing a Business Registration form. This information gives the Department of Labour & Pensions (DLP) a better understanding of the type of work carried out, the equipment used, and the number of persons employed as well as the location of the business.

Charitable Organisations
Any business that has been registered by the General Registry as a Non-Profit Organization and seeks to be recognized by the Department of Labour & Pensions as a charitable organization pursuant to the Labour Act (2021 Revision) is required to make an application to the Director of Labour & Pensions. All applicants are required to submit all required supporting documentation at the time of application for the Director’s consideration. Incomplete applications will not be processed. Gratuity
All establishments that seek to collect and Distribute Gratuities in the Cayman Islands are required to submit a registration application to the Director of Labour & Pensions for review and approval prior to the engagement of gratuities. The Department of Labour & Pensions is mandated to register and monitor all service providers who seek to charge guests/patrons an additional service charge known as gratuity. Gratuity can only be charged to guests/patrons upon obtaining the approval to do so from the Director. Once approval is granted, businesses that are registered to collect gratuity are then monitored and randomly inspected to ensure that gratuity is being collected and distributed to employees fairly and in accordance with the establishment’s approved plan and the Labour Act (2021 Revision).
Who can take part in gratuity? - All service employees apart from those of managerial level which includes the following:
- Food and beverage facilities and services;
- Night club;
- Engineering or maintenance;
- Housekeeping
- Security
The employees of managerial level include:
- Every employee who is employed by the service employer to perform the functions of any description of manager, director or chief; and
- Every employee in a position of supervision or control over part of all of any one or more of the following parts of the service employer's business-
- Administration, finance, reservations or personnel;
- Kitchen, restaurant or dining room;
- The provision of catering banqueting or other related facilities and services;
Labour Act Training
The Labour Investigations Unit is also a key contributor to the training of private sector employers on all areas of the Labour Act in an effort to continually improve employers' understanding of the Act as well as their compliance.
